What is a property search mandate?
The property search mandate, sometimes called a "buyer's mandate," is a contract signed between an individual looking to purchase a property and an agent, such as a property hunter or a real estate agency.
By signing a property search mandate, you entrust the agent with the task of searching for and finding an apartment, house, or building plot that meets your requirements.
Once the ideal property is found, the agent supports the buyer through every stage of the real estate purchase, from the purchase offer to the signing of the final deed.

Difference between a buyer's mandate and a seller's mandate
A seller's mandate is essentially the opposite of a buyer's mandate. This contract is signed between an individual who wishes to sell their property and a real estate agency whose services they have engaged.
In this case, the agent is responsible for presenting the apartment, house, or building plot to potential buyers and supporting the owner throughout the sale of their property.
Rights and obligations of those signing a buyer's mandate
Signing a search mandate creates a binding contract for both parties.
On one hand, the buyer agrees to :
- pay a commission to the agent once the property sale is finalized,
- inform the agent of any purchasing process they are involved in. For instance, they must not attempt to bypass the agent by negotiating directly with the owner of a property that interests them,
In return, the agent agrees to :
- offer the buyer opportunities to view properties that meet their search criteria,
- conduct their search transparently, ensuring the buyer is kept informed of progress by sending regular status reports,
- leverage their expertise to assist the buyer by sharing useful information to help them make an informed purchasing decision.
Finally, a real estate professional can only have a search mandate signed if they hold a T-card. This is a document issued by the Chamber of Commerce and Industry (CCI), valid for 3 years, which certifies the skills and authorization of a real estate professional to carry out various real estate transactions: buying, selling, renting, or subletting.

How much does a property search mandate cost?
In principle, a property search mandate involves paying a commission to the property finder. These are what we call “agency fees.”
This commission is only payable once the real estate transaction is finalized. Signing the mandate, a purchase agreement, or a preliminary sales contract does not justify charging agency fees. Only after the final deed of sale is signed is the agent entitled to receive their fees.
Furthermore, the agency fees associated with a property search mandate are not considered part of the property's sale price. Consequently, they are excluded from the calculation base for notary fees. Therefore, signing a property search mandate can be a source of savings!

The legal framework for property search mandates
The legal framework for the property search mandate was initially governed by the Hoguet Law, enacted in 1970. In March 2014, the Alur Law updated the regulations in force for the real estate market.
The Alur Law stipulates that:
- The property search mandate must be signed before viewing the property. If it is signed after the property to be purchased has been discovered, it may be considered a maneuver to reduce notary fees.
- The agent must hold a T-card or be authorized by a T-card holder.
- Signing the property search mandate does not justify the immediate payment of fees to the agent.
- The duration of the search mandate must be time-limited,
- 3 months after signing, an exclusive search mandate can be terminated at no cost
- The agent must guarantee their client access to a mediation process (if needed)
Contents of a search mandate
To be legally valid, a search mandate must precisely detail the agent's mission, their compensation, and the conditions to be met in order to carry out this mission.
In practical terms, a search mandate must contain the following information:
- Identity of the buyer : full name, marital status, nationality, etc.
- Identity of the agent : agency name, business registration number (SIRET), professional license (carte T), professional liability insurance, etc.
- Agent's compensation : fees can be a percentage of the property's sale price or a fixed amount.
- Characteristics of the property sought : type of property, geographic area, condition of the property, number of rooms, heating system, energy performance, neighborhood, buildability, etc. It is important that the property description be as detailed as possible.
- Price of the property sought : it is not mandatory to provide a fixed price, but at least a price range,
- Duration of the mandate : generally 3 months, with automatic renewal and the option to terminate without penalty after this period,
- Duty of information and transparency : the search mandate must describe the methods used by the agent to keep their client informed
- Type of mandate : the contract must specify whether it is an exclusive, semi-exclusive, or non-exclusive search mandate
Non-exclusive and exclusive mandates
A non-exclusive search mandate allows you to enlist the services of one or more property hunters. This type of contract also allows the buyer to conduct their own searches and purchase a property they like directly.
An exclusive search mandate entrusts the property search solely to the agent. This type of mandate may also grant the agent the authority to negotiate the property price with the seller and even sign a preliminary sales agreement.
In this case, if the buyer finds a property they wish to purchase on their own (or through another intermediary), the agent is still entitled to their fees.
In practice, it is more advantageous to sign an exclusive search mandate if you are looking for a property with specific characteristics. By signing an exclusive mandate, the property hunter can fully commit to finding your property because they are not competing with other professionals (or yourself). This allows you to benefit from high-quality support.
